Terms and Conditions

By accessing or using the AMAYA PH platform ('Service'), you agree to be bound by these Terms and Conditions ('Terms'). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all users of the platform, including students, teachers, schools, employers, parents, and any other visitors or users.

We reserve the right to modify these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the new Terms.

You must be at least 13 years old to use this Service. Users under 18 must have parental or guardian consent.

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You must notify us immediately of any unauthorized use of your account or any other security breach.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

One person may only maintain one student account. Creating multiple accounts to exploit platform benefits is prohibited.

AMAYA PH offers a credit-based enrollment system where students can enroll with ₱0 upfront payment.

By enrolling through the credit system, you agree to the automatic allocation of 70% of your platform earnings toward tuition repayment.

The remaining 30% of earnings will be credited to your personal savings account.

Credit limits are determined based on course enrollment, academic standing, and platform participation.

Failure to actively participate in platform work or academic activities may result in credit suspension or account restrictions.

All financial transactions are processed in Philippine Pesos (₱). Exchange rates for international transactions are determined at the time of transaction.

AMAYA PH reserves the right to modify commission rates and allocation percentages with 30 days' notice to users.

Students participating in the work platform agree to complete assigned tasks professionally and within specified deadlines.

All work submitted must be original and not infringe on any third-party intellectual property rights.

AMAYA PH takes a commission of 25-35% on all work completed through the platform. The exact rate depends on task type and client agreements.

Quality standards must be maintained. Consistent poor-quality work may result in reduced task assignments or account suspension.

Students retain the right to decline tasks but must maintain minimum participation levels to remain in good standing.

Client ratings and feedback are final and will be reflected in your platform profile.

Disputes regarding work quality or payment will be resolved through AMAYA PH's arbitration process.

By publishing on the Thesis Marketplace, you warrant that you are the original author and have full rights to the content.

AMAYA PH retains 30% of all thesis sales as a platform fee. Authors receive 70% of each sale.

All submissions undergo plagiarism detection. Content found to be plagiarized will be removed and may result in account termination.

Pricing is set by the author within platform guidelines (₱50 - ₱1,000+ depending on content type).

AMAYA PH grants buyers a license to use purchased content for personal, educational, or research purposes only. Resale or redistribution is prohibited.

Authors grant AMAYA PH a non-exclusive license to display, market, and distribute their content on the platform.

AMAYA PH reserves the right to remove content that violates academic integrity standards or these Terms.

The AMAYA PH platform, including its design, features, and content, is protected by copyright, trademark, and other intellectual property laws.

Users retain ownership of their original content (coursework, thesis, work submissions) but grant AMAYA PH a license to use, display, and distribute such content on the platform.

You may not copy, modify, distribute, or create derivative works from our platform without written permission.

The BATHALA AI system and all related technology are proprietary to AMAYA PH.

User-generated content that infringes on third-party rights will be removed, and the user may face account suspension.

Your use of AMAYA PH is also governed by our Privacy Policy, which is incorporated into these Terms.

We comply with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173) and other applicable data protection laws.

We collect and process personal data necessary for platform operation, including but not limited to: name, contact information, academic records, work history, and financial data.

Student progress data may be shared with authorized parties (parents, teachers, school administrators) based on user privacy settings.

We implement industry-standard security measures to protect your data but cannot guarantee absolute security.

You have the right to access, correct, and request deletion of your personal data, subject to legal and operational requirements.

You agree not to use the platform for any unlawful purpose or in violation of these Terms.

Prohibited activities include but are not limited to:

• Submitting plagiarized or fraudulent content

• Creating fake accounts or misrepresenting identity

• Cheating on assessments or manipulating platform metrics

• Harassing, threatening, or abusing other users

• Attempting to hack, exploit, or compromise platform security

• Sharing account credentials or accessing others' accounts without permission

• Using automated tools or bots to interact with the platform

• Circumventing the credit or payment system

Violations may result in warnings, temporary suspension, permanent account termination, or legal action.

AMAYA PH provides the Service 'as is' and 'as available' without warranties of any kind, express or implied.

We do not guarantee that the platform will be uninterrupted, secure, or error-free.

AMAYA PH is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you have paid to AMAYA PH in the past 12 months.

We are not responsible for the quality, accuracy, or legality of user-generated content or third-party services accessed through the platform.

You agree to indemnify and hold AMAYA PH harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

You may terminate your account at any time by contacting support. Outstanding credit balances must be settled before account closure.

AMAYA PH may suspend or terminate your account for violations of these Terms, fraudulent activity, or extended inactivity.

Upon termination, your right to use the Service immediately ceases. Some data may be retained as required by law or for legitimate business purposes.

Provisions that by their nature should survive termination (including intellectual property, liability limitations, and dispute resolution) shall remain in effect.

Any disputes arising from these Terms or use of the Service shall be resolved through good-faith negotiation.

If negotiation fails, disputes shall be submitted to binding arbitration in accordance with Philippine arbitration laws.

Arbitration shall be conducted in Metro Manila, Philippines, in English or Filipino.

Class action lawsuits and class-wide arbitration are not permitted. Each user may only bring claims in their individual capacity.

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
